1.4 The Countryside Explorer web site is an information web site or portal with web space/page advertising and promotional options for the owners and/or managers of businesses of physical places locations or services and delivers this information via the Internet to consumers. The www.countryside-explorer.com web site provides search functions e-mail links and links to other web sites that may be available on the www.countryside-explorer.com web site from time to time.

1.5 In this Statement under points 1 - 16 here and below unless otherwise stated or required by the meaning of the text the terms set out in column 1 below shall have the meanings set out in Column 2:-

3 DISCLAIMER

3.1 All content and services provided on the Web site are provided in good faith on an as-is basis. Much of the content is provided by advertisers. Whilst Countryside-Explorer Ltd and/or its Agents have taken considerable time and effort reviewing the content provided by Advertisers and making available the services on the Web site, neither Countryside-Explorer Limited nor its Agents.:
  • are responsible for the timeliness or otherwise of the content or any information being made available to you;

  • are responsible for the timeliness, deletion or failure to store any user communications or personalisation and web site
    customisation settings, and

  • take any responsibility or liability for the Links to other web sites that are provided for your convenience and the Company accepts no responsibility or liability for the content of those sites or for any external site which links to www.countryside-explorer.com.

  • make representation or warranty as to the accuracy of the content or the suitability or reliability of the information

3.2 Neither Countryside-Explorer Limited or its Agents give warranty as to the probity honesty reliability or any other behavioural or other characteristics of the users of the Web Site and neither Countryside-Explorer Limited or its Agents make any guarantee as to the commercial or other responses advertisers on the Web Site may receive as a result of loading (or supplying to the Company or its Agents) their Place Data for presentation on the Web Site.

3.3 The web site gives references as options or general information as to the search areas or distances between places in Kilometres that are given a guide only and are based on straight line "as the crow flies" basis. Users should be aware that distances driven between places using any form of transport are likely to result in longer journey's than those implied by the website and neither Countryside Explorer Limited nor its Agents or other Representatives give any warranty as to the actual distances experienced by users of the web site nor to the journey times taken between places based on the distance information supplied by the web site.

3.4 The web site allows map based searching by the geo-political regions of Great Britain and Northern Ireland. Where such searches are directed at the edge of a regional map and within the set search radius products services and information from adjacent regions will be presented and therefore neither Countryside-Explorer nor its Agents can guarantee that a users Place Data will only be presented in the geo political region is which they reside or in which their product or service is located.


4 COUNTRYSIDE-EXPLORER DATA PROTECTION & PRIVACY POLICY

4.1 Countryside-Explorer Limited, producer of the Countryside-Explorer Web Site, believes that online privacy is crucial for the ongoing success of the Internet as a service, commercial and entertainment medium. Any details which you provide to us from which we can identify you are held and processed lawfully and in accordance with the Data Protection Act 1998.

4.2 We collect personal information from you primarily to make using the Countryside-Explorer services easier and more satisfying. In registering for certain services offered by Countryside-Explorer you may be asked to provide your name, e-mail address, post code and other information. What information does Countryside-Explorer gather/track and how is it used?

4.3 Information gathered online can generally be categorised as either anonymous or personally identifiable. Anonymous information is information that cannot be traced back to a specific individual.

4.3.1 Gathering and Use of Anonymous Information.

Each time a visitor comes to the Countryside-Explorer web site, we collect some information to improve the overall quality of the online experience, including product monitoring, product improvement, and targeted advertising. When appropriate, users will be given the opportunity to receive information from third-party organisations in connection with services or events offered through or by Countryside-Explorer Limited. This option may be made available through Countryside-Explorers' registration and/or through registration processes maintained by a participating third party. In all cases, you will be informed before you register for the event or service that a third party will be receiving the registration information you provide and you will have the option not to participate in any service or event that requires third party involvement.


Use Of Countryside-Explorer Cookies; Countryside-Explorer's web site uses cookies to track traffic flow and patterns of travel within and through the sites. Cookies are a standard Internet technology that allow us to both store and retrieve login information on a user's system. Our Web server automatically asks a new user whether his or her browser will agree to accept a Countryside-Explorer cookie file. If a visitor accepts, our Web server will identify the user's cookie for Countryside-Explorer's use in internal reporting. If a user accepts a Countryside-Explorer cookie, but would later like to remove it from his or her computer, he or she can just remove it from the browser.


With whom does Countryside-Explorer share the information it gathers/tracks?

4.4 Countryside-Explorer Limited shares the information it collects depending on the uses to which it can be out to advance the services of the web site to its users:-

4.4.1 Demographic Information
When we do present information to our advertisers, it is in the form of grouped statistics compiled from our users' answers to survey questions and on-site behaviour. Countryside-Explorer will not disclose the contact or demographic information of any individual user to advertisers or any other outside organisation without the express permission of the individual.

4.4.2 User Research
On occasion, Countryside-Explorer will make available to potential advertisers and research firms aggregated results from research it has conducted on its user base. Once again, Countryside-Explorer will only provide such demographic information on an aggregated basis and does not disclose individual member profiles without user consent.


5 SECURITY

5.1 Our site is certified through our fulfilment partner as a recognised SSL secure shopping site. Your payment details are transferred directly to our fulfilment partners (they are never stored on the server) using PGP military grade encryption.

5.2 This web site takes precautions to protect users information. When sensitive information is submitted via the web site, that information is always encrypted.

5.3 We treat all customers details as strictly confidential and will never pass on your details to third parties. All customer data is collected at the time of ordering and is done so lawfully and in accordance with the Data Protection Act 1998.

7 COUNTRYSIDE EXPLORER EDITORIAL POLICY

7.1 The Countryside-Explorer editorial team seeks to present a pleasurable informative and safe experience to its users through information details and pictures published on the web site so that in the opinions of the majority of normal and reasonable people the experience of using the web site is :-

Decent and acceptable to all age of persons and includes no pornographic or subversive references or material likely to offend people of any age should they use the web site

Devoid of any overtly political material or material of a campaigning nature other than such material relating to fund raising schemes for charities and other good causes for the countryside and rural areas that are approved by the editorial team of Countryside-Explorer Limited

Provides an accurate and informative summary of the products services or information offered within the limits of the publishing option chosen

7.2 In so far as in the opinion of the editorial team of Countryside-Explorer Limited Place Data loaded by users or details submitted to Agents by users does not meet the standards set in 7.1 above Countryside Explorer Limited reserve the right to strike out or not publish the sub standard details.

7.3 Countryside-Explorer Limited will make its best endeavours to ensure that its editorial policy and standards are applied quickly and uniformly across the web site but users must accept that there will be times an early correction of sub standard details is not possible.

7.4 Where sub standard details are noticed or experienced by users either on the website or via a bad or misrepresented product or service found on this web site users are encouraged to notify the editorial team immediately so that we can take the appropriate action as soon as possible.

7.5 Countryside-Explorer Limited reserve the right to correct minor errors of spelling or changes texts to enhance the meaning or clarity of the text submitted as Place Data or supplied to Agents. Where the changes made are of significance the Company will first agree these changes with the subject user.

7.6 Photographs pictures and logos loaded as Place Data or passed to Agents for presentation on the web site must be of sufficient clarity and decency when presented to meet the high standards set buy the editorial team of Countryside-Explorer Limited. Where in the opinion of Countryside-Explorer Limited the pictures do not meet the required standards of clarity and decency the Company will notify the user prior to publication and offer solutions to improve the pictures or may offer alternative pictures or images.

8 REGISTERING ON THE WEBSITE:

8.1 You agree to provide Countryside Explorer with current, accurate and complete information about yourself when registering for services or promotions on the website. You also agree to notify Countryside Explorer of any changes to that information to ensure that it is current and accurate at all times. This is known as your personal data.

8.2 Countryside Explorer may also issue you with a password and account designation to enable you to access parts of the website. You are solely responsible for maintaining the confidentiality of your account designation and password and for all activities that occur using your account designation and password. You must also ensure that you exit your account at the end of each session.

8.3.1 You agree to notify Countryside Explorer immediately if there is any unauthorised use of your account or password.

8.4 You release Countryside Explorer from any liability that may arise in connection with any use of your account designation and password whether by you or by any third party.

9 PAYMENT POLICY AND DETAILS


9.1 Countryside-Explorer Limited offer several paying options for users wishing to advertise or promote their Place Data on the web site www.countryside-explorer.com. A user choosing a pay option will be paying a publishing fee for the presentation of his/her details on the web site after which their details will be available for presentation and available to users of the web site provisionally free of charge for a period of 12 months (the provisionally free of charge period) from the date that the Place Data is approved and first made available for publishing by the editorial team of Countryside-Explorer Limited.

9.1.1 Users wishing to maintain their details as available for publishing for a second or subsequent 12 month period at the end of a provisionally free of charge will be asked to pay for the preceding 12 month provisionally free of charge period which, subject to 8.3 below, will no longer be considered free of charge but in return the user will be offered a second or subsequent provisionally free of charge period being 12 months from when the former provisionally free of charge period is paid by the user.

9.1.2 In so far as a user does not wish to republish their details at the end of any provisionally free or charge period that same period will loose its provisional status and will be confirmed as free of charge by Countryside-Explorer Limited and at that point it is agreed that no further payments are due to Countryside -Explorer Limited from the User.

9.1.3 Method of Payment: It is possible to pay by cheque, VISA, Mastercard or Switch. The cardholders details must be provided as shown on their credit card, including the address as it appears on the credit card statement.

9.1.4 Receipts: After your purchase order has been submitted and your payment received an invoice will be sent to you detailing your purchase, customer service contacts and the total amount you are being charged. After your account has cleared your place details will be published.

9.1.5 Cooling off period: You have the right to cancel your order within 7 working days beginning the day after receipt, during this time you must provide written notice (an email is fine). Your payment, if it has been processed will be refunded in full within 30 days.

9.1.6 Currency Converter: Cost of foreign products or services may be subject to currency fluctuations.

9.1.7 Nothing in these conditions affects your rights as a statutory consumer.

10 COMPLAINTS:

10.1 We aim to deal with all complaints as effectively as possible. In the first instance your complaint may be e-mailed to customer.services@countryside-explorer.com or mailed to: Customer Services, Countryside Explorer Ltd, PO Box 6343, Kettering, NN14 4WA.

10.2 We aim to acknowledge any e-mailed or mailed complaint within 2 working days, and to conclude our investigations as soon as possible thereafter.


11 WARRANTIES & LIABILITY DISCLAIMER:

11.1 To the maximum extent permitted by law, Countryside Explorer disclaims all warranties, express or implied, relating to the content or services available on or accessible through the website.

11.2 The views herein are those of the editors, agents and advertisers, they do not necessarily reflect the views of Countryside Explorers ownership. Countryside Explorer does not take responsibility for information supplied on the website. Website users should take care and responsibility on themselves when purchasing/visiting products/services.

11.3 To the maximum extent permitted by law Countryside Explorer will not be liable for any loss, damage, cost or expense of any kind incurred by you arising in connection with your use of, or inability to use, the Website; and you release Countryside Explorer from all such liability.

11.4 This does not affect your statutory rights as a consumer.

12 INDEMNIFICATION:

12.1 You agree to indemnify Countryside Explorer, its associates, partners or any company or companies and their officers, directors, employees, agents, suppliers and licensors from and against all loss, damage, cost or expense (including legal costs) incurred in connection with your use of the website or any breach by you of these terms or any applicable local laws.

13 INTELLECTUAL PROPERTY:

13.1 You acknowledge that intellectual property rights subsist in the website (including its content and services) and any software used in connection with the website. These intellectual property rights are owned by Countryside Explorer or third parties as the case may be.

13.2 Except as permitted by law in any applicable jurisdiction, you must not:

* Decompile, reverse engineer, disassemble or otherwise reduce to human readable form any software used in connection with the website, nor permit any third party to do so or:
* Copy, modify, adapt or create a derivative work based on any of the software used in connection with the website.

14 TERMINATION:

14.1 Countryside Explorer may at any time change, delete, suspend or discontinue, temporarily or permanently, the content or services offered on the website and restrict or terminate your access to the website, without notice or liability.

15 JURSIDICTION:

15.1 These terms are governed by English Law and you submit to the non exclusive jurisdiction of the courts of England.

16 ENTIRE AGREEMENT:

16.1 The provisions of these terms and conditions and each obligation referenced herein, represent the entire agreement between Countryside Explorer and supersede any prior proposals, agreements or understandings (whether oral or written) not incorporated herein. In that any inconsistencies exist between these terms and any future published terms, conditions and notices of use or understanding of published terms or terms conditions and notices shall prevail.

16.2 A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other documents and records originally generated and maintained in printed form.

Any rights not expressly granted herein are reserved by Countryside Explorer.
